Ordinance for Zone Change 05RZ-075 to rezone a 98.7+- acre parcel from AE-37 (Exclusive Agricultural, thirty-seven acre minimum) to AE-37:AP (Exclusive Agricultural, thirty-seven acre minimum:Agricultural Preserve Combining) under Title 17 of the Tuolumne County Ordinance Code; and 3. Application 05WA-077 to rescind the existing Williamson Act land conservation contract applicable to 97.7+- acres and enter into a new land conservation contract pursuant to Tuolumne County Resoultion 106-04 for the entire 98.7+- acre parcel, including approval of the agricultural management plan.

Reasons for Exemption
After reviewing the project and its setting, the Environmental Coordinator for the County of Tuolumne has determined that the project is categorically exempt from review under the California Environmental Quality Act (CEQA), pursuant to Section 15317 of the State CEQA Guidelines because the project consists of entering into a land conservation contract under the terms of the Williamson Act. The Zone change portion of the project is required pursuant to Tuolumne County Resolution 106-04, in order to enter into a land conservation contract and serves to implement the contract through zoning. Therefore, the zone change is also exempt from environmental review pursuant to section 15317 of the State CEQA Guiddelines.
