Reasons for Exemption
The State CEQA Guidelines provide a series of statutory exemptions for actions that have been deemed to have minimal impacts on the environment. According to the CEQA Statute and State CEQA Guidelines, such actions are statutorily defined as "not" being project under CEQA. Section 21080.21 of the Statute and Section 15282(k) of the State CEQA Guidelines identify pipelines installed within road rights-of-way that are one mile or less in length as statutorily exempt from CEQA. The proposed interconnection pipeline falls in this exemption class. Therefore, this proposed action qualifies for this statutory exemption and is not considered a project under the CEQA.
