Determination of consistency with the Tuolumne County General Plan (TC08-013) of the disposition by Tuolumne County of three sites adjacent to Tuolumne Road North totaling 0.6 plus or minus acre. One site is zoned C-1:MX (General Commercial: Mobilehome Exclusion Combining), another is zoned R-3:MX (Multiple Family:Mobilehome Exclusion Combining) and the third is zoned both R-3:MX and C-1:MX under Title 17 of the Tuolumne County Ordinance Code. The purpose of the disposition is to vacate portions of land not needed for the road right-of way per an agreement between the County of Tuolumne and the adjacent property owners.

Reasons for Exemption
After reviewing the proposed disposition and its setting, the Environmental Coordinator for the County of Tuolumne has determined that the determination of consistency with the General Plan is statutorily exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15268 of the State CEQA Guidelines because the determination of consistency is a ministerial project as defined in Section 15369 of the State CEQA Guidelines because it entails making a determination based on an analysis of the Tuolumne County General Plan and whether the proposed action is consistent with it; consequently, the determination involves only the application of existing law and application of it to the facts as presented.
