Document Description
The applicant is requesting a variance from the required setbacks and parking to construct a new, two-story, single family home in the C-1 zone. The reduction in setbacks call for a decrease in the side property setback from six feet to five feet and a reduction in the rear setback from 15 feet to five feet. Reasons for Exemption
The proposed project is exempt from CEQA under Sections 15302 - Class 2: Replacement or Reconstruction and Section 15303 - Class 3: New Construction or Conversion of Small Structures. The Class 2 exemption provides for the replacement of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. The proposed project would replace a previously-existing residential structure. The new structure will be used for the same activities as the previous structure (as a residence). Therefore, this project qualifies for the Class 2 exemption. The Class 3 exemption provides for the establishment of new structures and specifically includes new single-family residences in zones that allow for residential uses by right. The project proposes a new single-family home in a C-1 zone, which allows for single-family uses by right. Therefore, this project qualifies for the Class 3 exemption. Because this project qualifies for both a Class 2 and Class 3 exemption, no further environmental review is necessary.
