In 2009, the East Bay Municipal Utility District (EBMUD) finalized a PEIR for the Water Supply Management Program 2040 after conducting a year long public review process. The PEIR was challenged in court, and EBMUD has now prepared these draft revisions to the PEIR to address the deficiencies identified in the order issued by the Superior Court for the County of Sacramento in the matter of Foothill Conservancy et al. v. East Bay Municipal Utility District, Case No. 34-2010-80000491.
