These proposed regulations for revising the existing regulations concerning solid Waste landfill closure and postclosure maintenance cost estimates and financial assurances demonstrations amend Title 27, California Code of Regulations (27 CCR), Division 2, Subdivision 1, Chapter 4, Subchapter 4, §§21780-21800, 21815-21840, and 21865 and Chapter 6, Subchapter 3, Article 1, §22234 and Article 2, §§22240, 22243, 22244, 22246-22249.5, and 22251-22253. The proposed state assumes responsibility for the specific activity due to a failure of an owner/operator and address the need for contingencies on all cost estimates and (2) include appropriate cleanup language for clarity and consistency.

Reasons for Exemption
The rulemaking process is exempt from CEQA because the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity is not subject to CEQA. Furthermore, the adoption of these regulations is exempt from CEQA pursuant to CEQA Guidelines Section 15308, the categorical exemption for actions taken by regulatory agencies to protect the environment. We reach these conclusions on the following grounds: the proposed regulations will not have any environmental effect because landfills already are required to provide financial assurances for solid waste landfill closure and postclosure maintenance. These regulations primarily clarify existing standards. To the extent they revise standards, these revised standards of clarify cost estimate and financial demonstration requirements that are more protective of public health, safety and the environment than current regulations. Such actions will protect and enhance the environment by providing increased assurances to the State that resources are available to properly close and maintain solid waste landfills.
