Document Description
A series of storms struck Northern California and Nevada in late December 2005 and January 2006. The Sacramento River, Truckee River and associated tributaries reached flood stage. High flows, high tides and winds were experienced in the Sacramento and San Joaquin Delta. A Federal Disaster Declaration was issued for 31 California counties due to floods, mudslides and landslides caused by these storms. This project site, known as 20051230-034-002 (MA 5) lies within the Jurisdiction of Maintenance Area (MA) 5 in Butte County, California. The site is located approximately 2.5 miles southeast of Chico about 0.25 mile downstream of the State Highway 99 bridge crossing on the left bank of Butte Creek.

Reasons for Exemption
As a result of the imminent threat of catastrophic levee failure, Governor Arnold Schwarzenegger proclaimed a state of emergency for California's levee system in February 2006. In the emergency proclamation, and in the Governor's Executive Order S-01-06 issued in March 2006, the Governor directed DWR to continue to identify additional levee sites that may require expedited repairs in order to prevent a catastrophic levee failure. Recent investigations by DWR and the U.S. Army Corps of Engineers have identified numerous additional levee sites throughout the State, which are in a substantially degraded condition and in need of immediate emergency repairs. On October 3, 2006, the Governor issued Executive Order S-18-06, which found that conditions of extreme peril to the safety of persons and property continue to exist along California's levees and other flood control systems. The emergency repairs for this project are necessary to maintain the levee system, which is essential to protect public health, safety, welfare, and to avoid a catastrophic levee failure. In September 2006, DWR made a determination that the Governor's Executive Order encompassed the PL 84-99 Order 1 and 2 sites of which this site is included.
