Reasons for Exemption
The project is statutorily exempt from compliance with CEQA because it is merely a continuation of a project approved, funded, and fully operated prior to November 23, 1970 and no modification or alteration in the Central Valley Project or the amount of water delivered is proposed.
The project is exempt under 14 CCR 15273(a)(1) to the extent that the Interim Contract Renewal requires changes in rates charged for water, those changes may increase the District's operating expenses. To the extent the District has to change water rates it charges its water users as a result of increases mandated by the Interim Contract Renewal those waters are exempt.
The project is also exempt under 14 CCR 15301 as it provides for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The project is wholly administrative in scope as the project involves no construction, alteration, or expansion of an existing use.
