Reasons for Exemption
The current use of the property (open space, vehicular recreation and natural preserve) will not change with the property transfer. The project is exempt under the General Rule because CEQA applies only to projects which have the potential for causing a significant effect on the environment. Because this project is a transfer of ownership from the County to the State with no change in land use, there is no possibility of a significant effect on the environment. The property is identified in the Habitat Conservation Plan as camping and riding area. The key consideration for exemption under Class 1 is whether the project involves negligible or no expansion of an existing use. The project is exempt under Class 1 because this project transfers land ownership only and will not change any land use nor does it expand land use.
