Reasons for Exemption
The adoption of the Ordinance is exempt because it can be seen with certainty that the Ordinance will not result in any adverse impacts on the environment. Moreover, the Ordinance is not "an essential step in a chain of events leading to a change in the physical environment" because: (1) the adoption of the Ordinance will not necessarily create a need for the San Jacinto River Levee, Stage 4, Project; (2) the construction of the Levee project is not entirely dependent on the adoption of the Ordinance; (3) regardless of whether this Ordinance is adopted, the Levee project may have to be constructed; and (4) CEQA review would be premature because no definite plans have been formed as to where or when to construct the Levee project.
