An application for an Authority to Construct for this project has been filed with the South Coast Air Quality Management District (SCAQMD). An exemption finding was made by Los Angeles County Department of Regional Planning in August 2006 under existing Conditional Use Permit 93-070.

Reasons for Exemption
The proposed project is a co-generation project at an existing industrial facility. The co-generation equipment will comply with all applicable air quality laws, will have a capacity of 15.33 MW (less than the 50 MW limit), and will result in a no net increase in air emissions (any increase in emissions will be offset by the SCAQD through their essential public services account in accordance with SCAQMD Rule 1309).
