Reasons for Exemption
Class 11 exempts construction, or replacement of minor structures accessory to existing commercial, industrial or institutional facilities. The proposed project includes the placement of one portable classroom on Foothill Oak Elementary School for use as a before and after school program (AM/PM Program). The AM/PM program is an accessory use to the existing school site, and the portable will not increase the student capacity of the school. Although portable classrooms are not expressly included in the list of structures or facilities eligible for exemption, CEQA guidelines § 15311 states that, the listed structures is intended to not be a limiting factor. The portable will serve as AM/PM program, which is accessory to the school operations and will not increase in student capacity. The addition of one portable classroom for AM/PM program use will not require demolition, but will require minor site preparation. There is no reasonable probability that the project will have a significant effect on the environment due to unusual circumstances because site is already developed with an elementary school.
