Reasons for Exemption
Section 15301(c) of CEQA consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Section (c) of 15301 allows for existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails and similar facilities (this includes road grading for the purpose of public safety). The proposed project is for tie and track replacement, installation of new ballast, installation of concrete or rubberized crossing panels, new sidewalks and paving at three rail crossings. Conduit will also be installed in anticipation of future safety improvements at each location. The proposed improvements will have no impact on the vehicular capacity or function of the existing right-of-way and will meet all required design standards.
