The Operator proposes to alter the bed, banks, and channel of an unnamed tributary to Santiago Creek for the purpose of restoring a segment of stream that was filled without notification to or authorization from the Department, and to restore capacity within an in-line pond (water impoundment, also used historically for irrigation) by the excavation of silt and sediment from the pond together with the construction of two fore-bays to control sediment entering the in-line pond. The activities will be conducted in four phases, with phase one consisting of the excavation of silt and sediment from the pond and the creation of the two fore-bays. The second phase will be the removal of wood chips, compost, and sediment from the stream, and the third phase will be the reconfiguration of the stream channel to achieve a natural channel morphology. The fourth phase is the installation and reintroduction of native vegetation to the reconfigured stream channel.
This action is required by Water Board Cleanup and Abatement Order No. R8-2005-0052, issued by Santa Ana Regional Water Quality Control Board and Felony Probation Agreement case No. 03CF1718, issued by the County of Orange Superior Court, for the protection of public health and the environment, in accordance with Section 15321, Chapter 3, Title 14, California Code of Regulations.
