Where it can be seen with certainty that there is not possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Staff recommends approval of substantial conformance for the revised Tentative Subdivision Tract Map and for approval of the road alignment improvement plans, along with the addition of a sentence to Mitigation Measure #2, allowing transplantation of elderberry shrubs only with the requiring State and Federal permits, where applicable.
