Reasons for Exemption
The dredge activity is a needed repair to a pubicly owned drainage facility to maintain a service essential to the safety of the public. Restoration of the channel capacity through the dredge activity will alleviate potential flooding impacts for up to 210 residential units. The proposed dredge activity will also alleviate endangerment of the El Camino Real roadway and bridge. El Camino real is a regionally significant arterial essential for the provision of the movement of goods, people and emergency services for the City of Carlsbad and neighboring communities. The proposed dredge project is part of a larger channel dredge and improvement project needed to protect the residents of Rancho Carlsbad and to maintain the integrity of El Camino Real. The accumulated sediment within the existing channel has reduced the flood carrying capacity to a point where flooding will occur in a relative moderate 20 to 25 year storm event. The region has entered into a period of wetter than normal rainy seasons and there is, therefore, a higher than normal probability of having a significant storm event that would endanger public safety. In consideration of the significant damage potential resulting from the flooding of the Agua Hedionda Creek and in consideration of the fact that the time required to complete the dredge activity exceeds the advance notice time for predicting major storm events, the City finds that the threshold of probability for occurrence of an emergnecy in this case warrants the declaration of an emergency to take actions to prevent or mitigate the emergency.
