Document Description
The City of Calistoga filed a Petition for Temporary Urgency Change in Place of Use and Purpose of Use with the SWRCB on July 29, 2004 seeking to add 88.72 acres owned by Rancho Alto Vineyards, Inc. (Rancho Alto) to its place is use and to add irrigation as a purpose of use. The Rancho Alto lands are not included in the Licensed place of use but have been historically served water under License 9615 pursuant to an agreement between a former landowner and the City of Calistoga.

Reasons for Exemption
The Temporary Urgency Change Petition involves the use of stored water under License 9615 to irrigate approximately 65 acres of existing and replanted vineyard on land that has been historically served water from this source. Thus the proposed temporary urgency change will not result in an increase in consumptive use allowed under License 9615 or a resultant increase in the amount of water diverted from Kimball Creek, and threrefore will not unreasonably affect fish, wildlife, or other instream beneficial uses within Kimball Creek. Additionally, all diversion and conveyance facilities are in place to serve water to the Rancho Alto parcel.
