Document Description
The levee maintenance project involves the driving of a 160 foot-long section of steel sheetpile into an existing levee in Discovery Bay. Reasons for Exemption
The levee maintenance project involves the repair and maintenance of an existing levee and involves no expansion of its existing use. The project involves minimal construction and as repaired, the levee will continue to have the same size, purpose, and capacity because the installation of the sheetpile will be flush with the existing levee surface. In addition, the poor habitat qualities of the artificial lagoon system cause there to be no listed species in the vicinity. Therefore, the project is exempt pursuant to the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment and, alternatively, pursuant to the Class 1, Class 2, and Class 3 categorical exemptions.
