Document Description
The proposed project by the State Water Project Analysis Office of the California Department of Water Resources is to waive certain financial provisions of its long- term water supply contracts. The proposed waiver to the long-term water supply contracts is the last sentence of Article 56(c)(6) of its long-term water supply contracts, which provides that ". . . [a] Contractor not participating in the repayment of a reach shall be required to pay a Use of Facilities charge of use of a reach for the delivery of water to, or return of water from, interim storage." Under this proposed waiver no use of facility charge would be applied when the interim storage is within the service area of another State Water Contractor that already participates in the repayment of the reach. The objective of this proposed waiver is to avoid duplication of charges for repayment of capitol costs that could be caused by charging participating contractors in a water exchange or storage agreement for use of a single aqueduct reach.

CEQA does not apply to a public agency's modification or restucturing of rates or other charges for obtaining funds for capitol costs necessary to maintian service within existing service areas. The Use of Facilities Fee being waived is collected for the purpose of repaying capitol costs of the aqueduct reaches being utilized for delivering water storage.
