Document Description
The request of Level (3) Communications, Inc., to consider Case Nos. 04RVP-00000-00004 and 04RVP-00000-00005 [application filed on May 16, 2002] for approval of a revision to a Final Development Plan, 00-FDP-011, and a Minor Conditional Use Permit, 99-CP-087, under the provisions of Article II, Sections 35-174.10 and 35-172.11 of the County Code, to allow a change in construction method applicable to a one-mile segment of a countywide fiber optic communication cabling project commonly referred to as "Level (3)". The specific revision involves modification of Permit Condition No. 76, enabling the applicant to install conduit by means of direct burial and directional boring around the northerly perimeter of El Estero Marsh within the Union Pacific Railroad right-of-way, rather than by one continuous bore under the marsh as originally approved by the Planning Commission in April 2000; and to approve the Negative Declaration, 04NGD-00000-00013, pursuant to the State Guidelines for Implementation of the California Environmental Quality Act.
