Document Description
The California Department of Fish and Wildlife (CDFW) has executed the Amendment to the Master Lake and Streambed Alteration Agreement number 1600-2012-0175-R6 (Master Agreement), pursuant to section 1602 of the Fish and Game Code to the project Applicant, McMillin Summerly, LLC, as represented by Brian Milich. The Agreement is a continuation of the previously issued Lake and Streambed Alteration Agreement (1600-2004-0130-R6). All development of the Project including Phases I, Phase II, and Phase III have been graded, and the 170-acre golf course and golf club have been constructed as described in the 1600-2004-0130-R6 Agreement. All homes in Phase I and II have been constructed as have most of the homes in Phase III, along with associated infrastructure. Construction of the remaining homes in Phase III, and associated infrastructure, occur outside of Fish and Game Code section 1600 et. seq resources. Construction of the 1.3-acre EVMWD Pump Station, and its associated infrastructure, is the last component of the original Project, that is currently under construction and is covered within the Agreement. It will provide water to the 356-acre wetlands by suppling reclaimed water as described in Compensatory Mitigation Measure 5.3 in the Agreement. The Agreement also covers routine maintenance activities that will need to occur within the 66-acre wetland mitigation area. The current Amendment is to remove the need for a conservation easement over the 66-acre wetland mitigation area described within Measure 5.2, 5.7, 5.8 and 5.9.4. All other terms and conditions still apply to the 66-acre wetland mitigation area such as the requirements for long-term management by a conservation entity under the Adaptive Management Plan.
