Document Description
Assembly Bill (AB) No. 2292 (effective January 1, 2003) added Section 65863 to the Government Code, which, in an effort to ensure each jurisdiction can accommodate their share of the regional housing need, sets forth restrictions on a jurisdiction's ability to reduce residential densities. The new law states that no city or county shall "by administrative, quasi-judicial, or legislative action, reduce, require or permit the reduction of the residential density for any parcel to a lower residential density that is below the density that was utilized by the Department of Housing and Community Development in determining compliance with housing element law..." The law does allow a jurisdiction to reduce residential density on a parcel if certain findings are made, or if density is increased on an alternative site, so that there is no net loss of residential unit capacity. To ensure the City's policies and codes are in compliance with State Law, the City is proposing an amendment to the General Plan and Zoning Ordinance to incorporate the new restrictions imposed by AB 2292. Incorporation of the State Law restrictions into the General Plan and Zoning Ordinance provides additional direction and clarification on how the existing General Plan policies regarding residential density are to be implemented.
