The proposed project is an application for an open space vacation on a portion of Lot 288 of Map 8031. The proposal is also an application for a boundary adjustment with a Certificate of Compliance to reconfigure the lot lines between Parcels A and B, to rectify the pool area and fence being built within the existing open space easement. The intent of the open space easement was for park and/or recreational purposes on lands directly abutting the site. The current owner bought their home approximately 8 1/2 years ago, and the existing backyard fence line was located outside of their property in an area of dedicated open space, unbeknownst to the owner. However, when the owner bought the property he was shown what was thought to be the property corners and he designed his backyard based on those property corners. In October of 1998, the applicant gave plans to their San Diego Country Estates Association for a pool, showing what he thought were the existing property lines. The San Diego Country Estates Association and the County of San Diego approved the plans, and the applicant received the proper permits to construct the pool and deck. The applicant never had the property surveyed, and after building the pool and deck, discovered that the pool area was outside of their parcel and belonged to the San Diego Country Estates Association. This open space vacation application is also being processed concurrently with a boundary adjustment (BC 02-0116) to rectify the pool area and fence being built on the open space easement.
