Document Description
The Hazardous Waste Facility Permit issued August 2001 contains a Special Condition that the facility enter into an enforceable agreement with the Department of Toxic Substances Control (DTSC) to perform corrective action or remediationof sites at the facility which have been contaminated by releases of hazardous substances or hazardous waste. Completion of the Special Condition has ben delayed due to the complexity of the agreement. Although identifcation of these sites, corrective action, and remediation have continued to take place, the State and the Navy do not have a signed agreement governing the respective rights and responsibilities of each party, or procedures for discharge of the obligations of each party. The Permit specified that the agreement must be signed within six months of the effective dates of the Permit. Approval of a Class 1* permit modification will extend the due date to February 8, 2003. This is the third extension of the due date. The additional extension is needed to continue the negotiations on the agreement, and to acquire approval of the other Senate agencies that are involved in addition to DTSC and the Department of Defense.

Reasons for Exemption
The project will have no significant environmental effect. Identification, corrective action and remediationof hazardous waste sites at the facility will continue while the agreement is negotiated and signed. DTSC will assure due progress in achieving the agreement and if needed can enforce corrective action and remediation prior to finalizing agreement through CERCLA, therefore delay in achieving agreeement will not result in physical changes to the environment.
