The City of Bakersfield is proposing to realign the Friant-Kern Canal to facilitate the ongoing development of public safety in the Rosedale area. The realignment would allow the future construction of a four-way, signalized, at-grade intersection at Calloway Drive and Olive Drive that would enhance traffic flow, provides a safe intersection, and improve response times by emergency services.

Reasons for Exemption
There is no possibility that the realignment of the Friant-Kern Canal at the intersection of Calloway Drive and Olive Drive would have any significant effect on the environment regarding aesthetics, biological resources, hazardous materials, mineral resources, public services, utilities, agricultural resources, cultural resources, hydrology, water quality, wetlands, noise, recreation, air quality, geology, soils, land use, population, housing, transportation and traffic. Regrading biological resources, the project site does not contain suitable habitat for any sensitive plant or wildlife speces; however, the project site may potentially be used as a kit fox trable route along the existing canal structure. The proposed project includes underground passageways for the kit fox and other wildlife. This underground passageway will separate these wildlife species from people and vehicles above ground. The implementation of the proposed project and the underground passageways and associated escape dens will not result in adverse impacts to the kit fox. In addition, all City of Bakersfield public works projects are covered by the existing Metropolitan Bakersfield Habitat Conservation Plan (MBHCP) and Section 10(a) permit. Any local road development project is subject to the terms of the Metropolitan Bakersfield Habitat Conservation Plan and associated Section 10(a)(1)(b) and Section 2081 permits issued to the City of Bakersfield by the United States Fish and Wildlife Service and California State Department of Fish and Game, respectively. Compliance with the MBHCP mitigates biolgoical impacts to a level that is less than significant. The Metropolitan Bakersfield Habitat Conservation Plan also exempts small scale local public works projects (less than 10 acres), undertaken for strictly public purposes and incidental to urban growth, from the MBHCP fee requirements. Large public works projects greater than 10 acres in size are subject to the fees. The portion of the project sitethat is subject to the MBHCP does not exceed ten acres in size. The purpose of the Friant-Kern Canal realignment at the intersection of Calloway Drive and Olive Drive is to facilitate the ongoing development of public safety in the Rosedale area. Th realignment would allow the future construction of a four-way, signalized, at-grade intersection at Calloway Drive and Olive Drive that would enhance traffic flow, provide a safe intersection, and improve response times by emergency services. The realignment is consistent with the adopted Metropolitan with the adopted Metropolitan Bakersfield 2010 General Plan.
