Document Description
The Dave Wilson Nursery sold a portion of parcel 008-011-02 to the Turlock Irrigation District for river restoration work, but they retained ingress and egress for riparian water rights. Project is to install a 10-inch siphon through a dike on Turlock Irrigation District property that separates the Dave Wilson Nursery property from the Tuolumne River, for the purpose of drawing upon their riparian water. As a condition of the land purchase the District agreed to contribute towards the cost of materials for the project. The water will be used to maintain the wetlands area adjacent to the District restoration project area.

Reasons for Exemption
The siphon is a very small structure constructed in a trench through a section of dike used as a haul road for an active aggregate mining operation (Class 3) The Reclamation Board permit for the adjacent restoration project does not consider the dike a flood control levee. There are only annual forbs growing on the site of the siphon. Construction on the riverside of the dike does not entail movement of existing rock and rip rap on the riverbank or within the river (Class 4). There are no endangered fish, terrestrial plant, or animals species that will be impacted by the construction. The District surveyed the site for endangered species during the recent restoration construction conducted at the site.
