Reasons for Exemption
Class 1 exempts the demolition and removal of individual small structures. Though portable classrooms are not expressly included on the list of structures eligible for exemptions, Section 15301 indicates the existing facilities itemized is not intended to be all-inclusive of the types of projects which might fall within Class 1. The removal of existing portables from the school site will make room for the placement of more modern portable classrooms. Class 2 exempts the replacement or reconstruction of existing structures and facilities, when the new structures will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. Though the replacement of portable classrooms is not expressly included on the list of replacement or reconstruction activities eligible for exemptions, this action will result in no net increase of student capacity or classroom space and the portable units will serve the same purpose as the portables being removed. There is no reasonable probability that the project will have a significant effect on the environment due to unusual circumstances because the site is already developed with a middle school.
