Document Description
On June 4, 2002, the Modesto City Council adopted an emergency interim ordinance that placed a 45-day moratorium on new development on unvested property in Village One. The City Council will consider extending the prohibition of approval in the Village One Specific Plan area of additional precise plans, tentative subdivision maps, tentative parcel maps, plot plans, use permits, rezonings, final development plans, and any other land use entitlement on unvested land, for a period of ten months and fifteen days.

Reasons for Exemption
This action is being taken in order to temporarily suspend development within the Village One area in order to prevent or mitigate an emergency due to inadequate funding to provide infrastructure. In addition, it can be seen with certainty that there is no possibility this action may have a significant effect on the environment, and therefore it is also exempt under Section 15061 (b) (3) of the CEQA Guidelines. This action is also exempt under Section 15308 of the CEQA Guidelines because the action is being taken to ensure the protection of the environment of the Village One Specific Plan area.
