Reasons for Exemption
This action consists of the operation of an existing facility that involves no significant change in the manner in which the project would be operated in the absence of this action. Therefore, this action is not a project under CEQA. However, if this action were considered a project under CEQA it would be exempt under a Class One Categorical Exemption because the operation involves a neglible expansion of use of an existing facility. The fishery monitoring information indicates that limited downstream migration of juvenile salmonids is occuring now. The present distribution of other Delta fishes indicates they are not unusually vulnerable to the direct effects of export pumping at this time. Fish facilities sampling indicates low rates of entrainment of fish in the south Delta. If fish appear in substantial numbers while Article 21 water is being pumped, then an EWA fish action will be declared and exports reduced with EWA not being charged for the resulting decrease in the Article 21 pumping that results from this program. The DWR has consulted with the Management A agencies and they have advised DWR that this action will not result in any significant environmental impacts.
