Document Description
The Operator proposes to alter the streambed to create 6.5 acres of high quality riparian habitat and restore an onsite borrow pit (2.7 acres) that was recently planted with Fremont cottonwood (Populus fremontii fremontii). The implementation of this project will occur in three phases. Phases I and III were authorized under a previous Streambed Alteration Agreement (SAA # 5-631-93). This Streambed Alteration Agreement authorizes activities only associated with Phase II. Phase II is mitigation required by the U.S. Army Corps of Engineers (Corps) for a violation of Section 404 of the Clean Water Act and involves the creation of an additional 3.0 acres of riparian habitat. Phase II will be carried out in the northwestern portion of the property. All upland areas in Phase II excluding the berm/hogback will be graded. Once this grading and the Phase I grading are completed, staff from the Environmental Trust, The U.S. Fish and Wildlife Service (Service) and the Department will delineate, using a Global Positioning System, the amount of wetland creation acreage that has been graded. If more than 5.8 acres of wetland creation acreage has been graded, then the berm can be removed. However, if less than 5.8 acres of wetland creation acreage has been graded, then the berm will remain in place. The location and/or type of mitigation obligation that will be accepted for the creation acreage deficit (at a minimum of 0.7 acre for the berm) will be determined by the Corps in coordination with the Service and may require an amendment to this agreement.
