Document Description
The proposed project is approval of a Removal Action Work Plan (RAW) for the excavation and offsite disposal of surface and subsurface soil contamination . The soil is contaminated with waste oil (A.K.A. total petroleum hydrocarbons). The removal action consists of excavating approximately 5,000 cubic yards of contaminated soil and transporting it as a designated waste to an appropriate permitted offsite disposal facility. The excavation will include the removal of surface deposits of waste oil and the removal and stockpiling of approximately three feet of clean overburden prior to the removal of a subsurface waste oil layer approximately nine inches thick. The excavation will be done on portions of seven one-acre properties located on Monarch Lane, Peacock Way and Pearlie Lane in Nipomo, California. These streets are cul-de-sacs (Monarch Lane and Pearlie Lane) or an entrance street to a cul-de-sac (Peacock Way). There is no through traffic on these streets.

Reasons for Exemption
1.) DTSC will be overseeing the project and will have provisions in its contract to stop work at its discretion. 2.) Control measures (e.g. water spraying or use of dust palliative) will be implemented during the soil excavation. 3.) A Site Health and Safety Plan including an air monitoring plan has been prepared to protect the worker and the public during the removal action. 4.) All wastes generated during cleanup will be properly disposed at an offsite facility. 5.) The excavation will be done exclusively on residential properties with the written approval of the property owners. From chemiocal analysis conducted on the waste oil, DTSC has concluded there is no significant health risk from exposure to waste oil. Consequently, the excavation of waste oil will not produce hazardous mists, dusts, or gasses.
