Document Description
On January 26, 1996, the State Water Resources Control Board, Division of Water Rights (Division) issued Permit 20820 to the William Hardin Trust to build the project proposed in Application 30118. The permit planned to construct three 49-acre-foot (af) onstream reservoirs and two 49 af offstream pit type reservoirs. Water is collected from three unnamed streams tributary to Pope Creek and directly from Pope Creek. The combined rate of diversion from Pope Creek may not exceed 10 cubic feet per second. The water appropriated under this permit is used for stock watering, hay production, irrigation of wine grapes, frost protection and heat control within the vineyards, incidental domestic use and recreation. The project is located in Napa County and includes 258 acres within sections 11, 14, 15, 22, and 23 all within T9N, R5W, MDB & M as shown on maps on file with the Division. The time to complete construction ended on December 31, 1998. The time to complete full beneficial use of water ended December 31, 1999. In 1998, the permittee filed a petition for extension of time to complete construction in 2008 and full beneficial use in 2009. The Division has determined not to issue an order approving the full amount of additional time requested in the petition. Full development and use of water must be completed by December 31, 2006.

Approval of this position will result in no environmental effects greater than those analyzed in the previous CEQA document. Mitigation measures have previously been included in the water right permit for this project that reduce potential environmental impacts to less than significance. Ther are no unresolved protests.
