Document Description
ECS Refining (ECS) has received a variance from manifesting requirements under Section 25160 of the California Health and Safety Code. The variance allows ECS to use a bill of lading in lieu of a manifest to transport metallic dross, tin/lead oxides, and filters with lead from its permitted hazardous waste facility in Santa Clara, California, to its recycling facility in Terrell, Texas. Transportation conducted pursuant to this variance must be by a California registered hazardous waste transporter. The hazardous waste is solely a non-RCRA hazardous waste or the hazardous waste or its management is exempt from, or is not otherwise regulated pursuant to the federal act; and the hazardous waste, the amount of the hazardous waste, or the hazardous waste management activity or management unit is insignificant or unimportant as a potential hazard to human health and safety, and the environment.

Reasons for Exemption
The issuance of this variance does not create a potential hazard to human health and safety or the environment because: 1. A bill of lading containing all information as required under Title 49, Code of Federal Regulations, Part 172, Subpart C, shall accompany each shipment of hazardous waste transported pursuant to this variance. 2. Copies of the bills of lading shall be kept at ECS's Santa Clara facility for at least three years. Shipments of these wastes shall be reflected in ECS's facility annual report as required by Sections 66264.75 and 66265.75 of Title 22, California Code of Regulations. 3. The waste must be packaged, labeled, placarded and transported in accordance with all applicable DTSC, Department of Transportation, and California Highway Patrol requirements. 4. The conditions of the variance require ECS to ensure safe and legal disposal of the waste. 5. The waste shall be transported only to ECS's authorized recycling facility in Terrell, Texas. No temporary storage facility will be used.
