Document Description
The application proposes to legalize an agricultural chemical service and sales facility in operation without a County land use permit for over fourteen years. Mid Valley has owned and operated the facility since November of 2000. The company has a store, office, shop, warehouse, chemical storage tanks, propane tanks and fueling station at the Livingston location. The warehouse and storage tanks contain various toxic materials including liquid and dry pesticides, herbicides and fertilizers. Only one material at the facility is deadly to humans in small doses, methyl-bromide, a gas which is kept in liquid form and contains tear gas as a release indicator. The company owns four trucks to deliver the materials to growers and portable dispensing equipment including wagons and trailers used to spread the materials in the fields. Large trucks fill the tanks with liquid chemicals and unload dry chemicals on pallets using the company forklift. Mid Valley employs two forklift operators and three drivers. A spill kit containing first aid supplies and clean up materials is kept in the warehouse. Mid Valley contracts with Wright Environmental (Exhibit A), a company that specializes in urgent response for chemical accidents, to provide emergency response in the event of a spill or leak. Chemical transports are covered by CHEMTREC - the Chemical Transportation Emergency Center (Exhibit B), an emergency response service provided by the Chemical Manufacturers Association.
