Document Description
Adoption of an Ordinance Amending Article 11, chapter 4 of the City of Modesto Municipal Code, pertaining to the Cable Television Franchise and adoption of an ordinance approving the Franchise Renewal Agreement with United Cable Television Corporation, a subsidiary of AT&T, including the following terms: A 10-year renewal of the cable franchise based on a rebuild of the cable system within the next 24 to 36 months and increase the number of channels available. At the end of the rebuild, the system will be ready for broadband services to be delivered to Modesto. An extension of the Franchise Agreement to 15 years (total) if AT&T completes the rebuild to broadband services within 24 months. Rebuild of the Institutional Network (I-Net) and completion of system construction and grounding work will bring the system into compliance with the City's Municipal code. Management of the Public-Education-Government (PEG) studio for a 12-month period and assistance in transitioning the management of the PEG studio to a community group selected by the City.

This project is Categorically Exempt from CEQA review under Section 15301 of the CEQA Guidelines, Existing Facilities. This section provides a Class I exemption for "operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination". Further, the project is categorically exempt under Section 15302 of the CEQA Guidelines, Replacement or Reconstruction, that provides a Class II exemption for "replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.
