Document Description
NOD for the release of the existing covenant that spans 1383 Borregas Avenue and 140-146 Caribbean Drive for solid waste access purposes. Pursuant to Title 18 (Subdivisions) of the Sunnyvale Municipal Code (SMC), a Release of Covenant requires approval by the Planning Commission (SMC 18.40.090) to allow recordation of a Release of Covenant. The approved Google Caribbean campus will result in a merger of several sites to create two main parcels, one on each side of the West Channel. The merger, along with the approved project, will eliminate the need for the Covenant of Easement for solid waste access.

The applicant has petitioned the City to release of the existing covenant that spans 1383 Borregas Avenue and 140-146 Caribbean Drive for solid waste access purposes. Pursuant to Title 18 (Subdivisions) of the Sunnyvale Municipal Code (SMC), a Release of Covenant requires approval by the Planning Commission (SMC 18.40.090) to allow recordation of a Release of Covenant. The merger, along with the approved project, will eliminate the need for the Covenant of Easement for solid waste access.
Other Information
On September 29, 1998, the City Council approved a Use Permit (Planning Application No. 1998-0969) for an addition to a commercial building at 1383 Borregas Ave. As part of the approval of the project, the applicant was required to work with staff to provide the adequate number of trash receptacles on the subject site due to a reconfiguration of on-site parking and solid waste areas. The location of the solid waste receptacles resulted in the need for cross easements for solid waste access. Because the sites were all under the same ownership, a Covenant of Easement had to be granted to the City for solid waste access. The Covenant of Easement was recorded with the County of Santa Clara on November 24, 1998. On May 12, 2020, the City Council approved the Google Caribbean Campus (Planning Application No. 2017-8042), which includes the two subject parcels which are part of a larger project campus of 40 acres with 1.04 million square feet of office space, parking garage, central utility plant, landscaping and improvements to the West Channel. The project also included a Vesting Tentative Map to merge several parcels into two main parcels. Construction for the approved project has begun and the existing buildings have been demolished.
