The Kern Facility is a non-operating power plant, consisting of two natural gas and oil fired units and associated equipment with a combined generating capacity of 140 MW. By order of the California Public Utilities Commission, Pacific Gas and Electric Company will return the Kern Facility to service for the benefit of the California ratepayers.

Reasons for Exemption
The CPUC has dismissed the application of Pacific Gas and Electric Company (PG&E) to sell the Kern Power Plant to the North American Power Group (NAPG) and has ordered PG&E to restore the Kern Power Plant to operational status. The order also requires PG&E to explore options whereby NAPG may restart and operate the facility under PG&E ownership. The entity proposing to restart the plant (either PG&E or NAPG) wil have to obtain State Energy Resources Conservation and Development Commission (California Energy Commission (CEC)) approval of an Application for Certification to restart the 140-MW plant. Public Resources Code Section 21080(b)(b) and CEQA Guidelines Section 15271 provide that CEQA does not apply to actions undertaken by a public agency relating to any thermal power plant facility if the thermal power plant facility will be the subject of a document that will be prepared by the CEC pursuant to a regulatory program certified pursuant to Public Resources Code Section 21080.5. The CEC process to review an Application for Certification is a CEQA-equivalent regulatory program certified pursuant to public resources Code Section 21080.5. Therefore, the statuatory exemption applies to the early activities undertaken by PG&E to implement the CPUC order.
