Pursuant to the Stipulation For Settlement and Entry Of Judgement (SFS&EJ), Evergreen Oil, Inc. (Evergreen) has been authorized by the Department of Toxic Substance Control (DTSC) to modify its existing use oil refining facility to abate certain violations of its hazardous waste facility permit. As a part of the settlement, Evergreen has applied to make these changes permanent through a permit modification. These modfications are authorized by the SFS&EJ order until such time as the regulatory permit modification process can be completed.

As a regulatory agency, DTSC is taking action to enforce the provisions of the hazardous waste facility permit pursuant to Health and Safety Code sections 25201 (a), 25250.16(b) and Title 22 California Code of Regulation , section 66266,100 et seq.. DTSC has determined that the proposed operational changes at the Evergreen Oil, Inc. facility would significantly reduce risks at the facility and provide for safeguards that would effectively remove these hazardous wastes from the facility.
