Document Description
Variance to Santa Clara County Hazardous Materials Compliance Division from Health and Safety Code, section 25160. This variance will allow the Santa Clara County Hazardous Materials Compliance Division to pick up, transfer and deliver abandoned wastes that have been previously collected by other public agencies and consolidated at household hazardous waste collection facilities. The variance is limited to the transfer of abandoned HHW and CESQG wastes only.

Reasons for Exemption
The transfers will be conducted by qualified personnel, trained in hazardous waste management and all activities will be carefully regulated by variance requirements to assure against any environmental concerns. Wastes will be packaged per DOT specifications and hauled by registered hazardous waste hauler. The limited scope of operations and shipment of wastes to a facility designed to manage the wastes limits the potential for any risk of upset or accident.
