Document Description
A modification of a Conditional Use Permit to include but not be limited to an increase in pit depth and a one-time excursion into a 5-acre area outside the permitted mine boundaries for this Conditional Use Permit (Resolution 182-82; approved July 1, 1982) which allowed a surface mining and reclamation plan in accordance with the Surface Mining and Reclamation Act of 1975. The project site is an existing shale gravel mine permitted for a 10-acre area within an approximate 76-acre parcel. During a recent survey of the mine site, it was determined that the permitted depth limit had been exceeded and that the operator had encroached on an approximate 5-acre area outside the permitted mine boundary. The project includes a request to remove a condition that requires the operator to leave the mine site level with surrounding terrian, thus allowing for an increase in depth to 75 feet and to allow for a one-time excursion into an approximate 5-acre area adjacent to but outside the permitted mine boundary. The area impacted by the one-time excursion is to be immmediately reclaimed and no additional disturbance is proposed in the area.
