Assembly Bill 1843 (Brown, statues of 1989) established the waste tire program and required the IWMB to adopt emergency and final regulations for permitting of waste tire storage facilities. These were adopted on June 26, 1991, and final regulations on August 25, 1993. The final regulations, contained several exclusions from permit requirements. The exclusions include Recycling Business 14 CCR 18420 (b) ; Indoor Storage 14 CCR 18420 (a) (4) ; and General Exclusions 14 CCR 18420 (c). The exclusions were revoked as a result of difficulites with tracking, as well as environmental and public health and safety issues as a result of improper waste tire storage practices. On June 16, 1998, the Office of Administration Law approved emergency regulations that removed the exclusions from the Tire Storage Regulations, specifically those sections cited above. Operators whose exclusions were revoked are now subject to waste tire storage standards and are required to obtain Waste Tire Storage Permits, and comply with the waste tire storage standards.
