Document Description
The ordinance adopts the City's Electric Utility Direct Access Program which provides eligible participating electric utility customers the right to purchase the energy component of their service from third party energy service providers. One resolution approves the form agreements to be submitted to Silicon Valley Power's electric customers and to the service providers who participate in the City's Direct Access Program. The second resolution adopts the utility rate schedules and revised rules and regulations. The entire project is subject to legal validation before commencement.

The ordinance and resolutions are exempt from CEQA under Guidelines Section 15273(A) and 15378(b)(4). The funds generated will be used to meet the Electric Department's operating expenses (15273(a)(1)); for purchasing energy supplies (15273(a)(2)); to meet financial reserves (15273(a)(3)) and to obtain funds for capital projects (15273(a)(4)). This project creates government funding mechanisms which do not involve commitment to any specific project which may result in a potentially significant physical impact on the environment.
