Implementation of the Settlement Agreement with the Morgan Hill Unified School District (MHUSD) and the City of Morgan Hill (Morgan Hill), which requires the City of San Jose to accept conveyance from MHUSD of fee title to approximately 75 acres of land for open space purposes; grant an easement to MHUSD to construct and maintain stormwater facilities, a water service connection and other public utility connections over approximately 50 acres of land conveyed to the City; approve an agreement to allow MHUSD to temporarily use portions of the land conveyed to the City to construct the stormwater facilities and as a construction staging area for the Second Comprehensive High School Project; and approve a memorandum of understanding among MHUSD, Morgan Hill and the City consenting to the provision by Morgan Hill for water, sewer and police and fire services to the portion of the Project located in the City of San Jose.
