THE PROPOSED PROJECT IS THE ACQUISTION, TRANSFER AND USE BY MWA OF UP TO 25,000 ACRE-FEET PER YEAR OF STATE WATER PROJECT TABLE A WATER ENTITLEMENT FROM THE BMWD.IN ADDITION THE ACTION WOULD DETACH APPROXIMATLY 8930 ACRES OF LAND FROM THE BMWD. UNDER THE ACQUISITION AGREEMENT BMWD WOULD HAVE THE FIRST RIGHT TO ANNUALLY PURCHASE FROM MWA ANY PORTION OF THE ENTITLEMENT NOT BEING UTLILIZED BY MWA FOR FIVE YEARS FOLLOWING CLOSE OF ESCROW FOR THE PURCHASE. THE BMWD AND KERN COUNTY WATER AGENCY (KCWA) THE KCWA/DEPARTMENT OF WATER RESOURCES (DWR) AND THE MWA/DWA WATER ENTITLEMENT CONTRACTS WILL ALSO BE AMENDED TO ACCOUNT FOR THE MWA'S ACQUISITION OF ADDITIONAL TABLE A ENTITLEMENT.EXISTING OR APPROVED WATER DISTRIBUTION FACILITIES WILL BE UTILIZED TO THE ADDITIONAL IMPORTED WATER TO THE MWA SERVICE AREA.
