The project area is zoned "MX" (Mixed Use), which allows for a mix of residential, commercial and industrial park uses. Current land uses include cultivation of row crops, farm operation support buildings, and 68 acre construction site for R&D office campus.
Document Description
Adoption of a General Plan Amendment and Zone change from "MX" (Industrial Park) for a 226-acre site, and a Development Agreement including design guidelines. Shortly after adoption of the "MX" designation in 1997, the City of San Jose, Browning-Ferris Industries and the Santa Clara Audubon Society took legal action to prevent development under the new "MX" designation, due to concerns that the proposed residential land uses would not be compatible with adjacent uses (i.e. the operation of the Santa Clara/San Jose Water Pollution Control Plant and Newby Island Landfill) or habitat values along Coyote Creek. As part of the legal settlement, an agreement was reached between the City of Milpitas, the City of San Jose, BFI, the Audubon Society and the project proponent that would allow development to long as the site was re-designated back to non-residential uses and limited to 35% Floor Area Ratio. The current GPA is in responsible to that agreement.
