The California Department of Toxic Substances Control (DTSC), pursuant to authority granted under California Code of Regulations, Title 22, Division 4.5, Chapter 20 prepared an Addendum to a previously certified Environmental Impact Report (EIR) for the renewal of a Hazardous Waste Facility Permit (Permit) for ten years for the Clean Harbors Wilmington, LLC (CH Wilmington) facility. DTSC prepared an Addendum pursuant to a previously certified 1995 EIR (State Clearinghouse Number 1995102090) due to updates to the CEQA Guidelines and not as a result of project changes. The Permit Renewal will authorize continued storage and treatment of hazardous waste. The Permit does not include any physical changes, changes in operations, construction, or ground disturbing activities. CH Wilmington is located at 1737 East Denni Street in Wilmington, California 90744. Background: CH Wilmington is an approximately 2-acre commercial hazardous waste management facility which accepts hazardous and non-hazardous wastes in bulk and in containers. The wastes are stored at the facility prior to being shipped offsite for subsequent storage, treatment, recycling and/or disposal. The facility receives shipments of off-site generated wastes and segregates, classifies, and stores the wastes for processing on-site in one or more of the following general processes: (a) receiving and storing, (b) alternative fuels blending, (c) neutralization, (d) consolidation of compatible materials, (e) management of empty containers, (f) transfer of hazardous waste, and (g) chemical and physical treatment. The facility operates six (6) waste management units that include the Container Storage Warehouse, Roll-Off Bin Storage Area, 200 Series Storage/Blending Tanks, 300 Series Storage/Blending Tanks, Tank T-111, and Truck Unloading Area. The California Department of Health Services (predecessor to DTSC) issued an Interim Status Document to the facility (formerly Chemstar) on August 30, 1983, to allow the facility to continue operating until a Permit was issued. The facility (formerly ENSCO West Inc.) was issued their first Permit by DTSC and made effective on July 30, 1995. DTSC circulated a draft EIR (State Clearinghouse Number 1994091010) for public review and comment in February and March of 1995 and filed a Notice of Determination on November 14, 1995 (State Clearinghouse Number 1995102090) for approval of a Permit. The facility changed ownership from ENSCO West Inc. to Teris, LLC in 2001, and then to Clean Harbors Wilmington, LLC in 2006. The Permit was renewed by DTSC effective September 15, 2011, and an expiration date of September 15, 2021. DTSC filed a Notice of Exemption (State Clearinghouse Number 2011098262) on September 19, 2011, for approval of the Permit Renewal. The Addendum is to the previously certified EIR and has been prepared to address activities associated with the Permit Renewal request and to amend the analysis of the previously certified 1995 EIR due to updates to the CEQA Guidelines, not as a result of project changes. The Permit Renewal will authorize CH Wilmington to continue operating as a commercial hazardous waste storage and treatment facility. All operating activities of the facility will continue as previously approved. This Permit Renewal does not include any construction, ground disturbing activities, or other physical or operational changes and all previous Permit requirements will remain in effect. This Permit Renewal will not result in any new or substantially more severe significant impacts on the environment.
