Specifically, the Project is a 50-year-term WSA, which provides that MWD would purchase and receive 1,430 acre-feet of potable water from the City annually, which would supply approximately one-third of MWD’s annual water supply needs. Although this Project is made possible by the restart and use of the Facility within its capacity, the City would have the right to supply water from any of its potable water sources. Under the WSA, the City would be obligated to deliver and MWD would be obligated to accept delivery of the water irrespective of hydrologic conditions, subject to certain conditions. The City would be required to reasonably manage its potable water supplies, including its Facility, such that water is available to meet the City’s delivery obligations under the partnership. Although MWD would have no ownership rights in the Charles E. Meyer Desalination Facility (Facility) and would have no control over its operations, the City would be required to maintain the Facility’s ability to promptly produce water if necessary to meet its delivery obligation under the WSA. To ensure delivery of water under a wide range of water supply conditions, the WSA requires a conveyance pipeline that would allow water to be moved from the Facility to the Cater Clearwell. The conveyance pipeline would be composed of a newly constructed pipeline and the re-purposing of an existing City transmission pipeline. The newly constructed segment of pipeline was analyzed under a separate EIR Addendum prepared by the City (see Appendix D, City of Santa Barbara Addendum for the Desalination Plant Conveyance Main Project 525 E. Yanonali Street (PLN2019-00111)).
