There was loose, unconsolidated soil around both ponds and no spillway connecting the lower pond back to the original channel. In the year since the initial violation occurred, the stream course has changed again, either through high flows during winter or additional equipment work. The notification describes the current project footprint as 38 lf of affected watercourse in a straight channel, about 1.5-2 ft wide at the base, and 3-5 ft deep from the natural ground level with nearly vertical banks.
