The SR 4 Bypass Project was the subject of a previous and separate CEQA review conducted by Caltrans. The action to be taken by the Planning Commission is the possible adoption of a CEQA Mitigated Negative Declaration for the Grading Plan for the overburden disposal site on private lands under the jurisdiction of the County. The overburden disposal pile will achieve a height that varies locally from 0 feet to 52 feet above original ground surface and will be constructed at a 2:1 maximum slope at finished grade. Where existing natural slopes are steeper 5:1, ""keyways"" shall be excavated into the natural ground surface prior to placement of fill materials. Fill areas will be seeded, fertilized and mulched between September 15 and October 15. Best Management Practices will be implemented to control erosion. The project will file a Notice of Intent to comply with the NPDES Stormwater Discharge Permit for Construction Activities and provide a Storm Water Pollution Prevention Plan. Preconstruction surveys will be conducted for nesting raptors, passerines, and non-passerine land birds for any work commencing between Feburary 1 and August 31.
