Where it can be seen with certainty that there is no possibility that the activity is not subject to CEQA. Furthermore, the adoption of these regulations is exempt from CEQA pursuant to CEQA Guidelines Section 15308, the categorical exemption for actions taken by regulatory agencies to protect the environment. We reach these conclusions on the following grounds: the proposed regulations will not have any environmental effect because landfills already are required to provide financial assurances for solid waste landfill closure and postclosure maintenance. These regulations primarily clarify existing standards. To the extent they revise standards, these revised standards of clarify cost estimate and financial demonstration requirements that are more protective of public health, safety and the environment than current regulations.
